6B. TERMINATION FOR Low Sales

This type of clause allows you to get your game back when a publisher has allowed it to go out of print or is not actively marketing it. You can make a clause based on a certain number of games, a certain amount of royalties, or both. The level of royalties is preferable -- if your game is on its way out of print and the publisher sells copies at a deep discount, the number of games sold might be above a threshold that would delay you getting the rights back.

DESIGNER is entitled to terminate this Agreement if in any 12 month period following the first 12 months after the product is first offered for sale to the public (including via the fulfillment of a Crowdfunding campaign or presales), PUBLISHER has not paid DESIGNER a minimum of $3,000 in royalties.
